Arbitration Guidelines


The Druid Clan petition included the following services:


Serve an intermediary between the common people and the gods.
Conduct rituals and host festivals marking the change of seasons.
Perform Druidic wedding ceremonies. If the wedding takes place at a druidic festival or if one of the marriage partners is a Druid, the Great Circle will not charge for their service AND will pay the gold portion of the marriage tax.
Teach people how to survive in the lands. (Note: Druids are NOT at beck and call for spell ups and corpse recoveries. We want people to learn to survive themselves without help.)
Function as judges in disputes.
Provide a balancing force between the excesses of Good and Evil. Note numbers 1 and 5.
The Immortals of Aardwolf approved the Great Circle of Druids for entrance as a Clan. What follows here are the Guidelines the Great Circle will use in its role as Aardwolf's arbitrators.

Please note that the Druids are sworn to fairness, not to righteousness. Thus, we serve as the center point, and will never seek to make a decision based upon anything other that the methods and procedures listed here. Also, decisions can be appealed to the Immortals in order to inspire the Arbitrators to act in a fair manner. Druids who do not act in a manner befitting their position will be punished.

Glossary:

Arbitration: 1. n. A method of alternative dispute resolution in which the disputing parties agree to abide by the decision of an arbitrator.
2. n. One method of settling disputes, including union-employer battles. The parties choose a third party to settle their disagreement. This is called binding arbitration when the parties also agree to abide by the arbitrator?s decision.
Sanction: 1. n. A financial penalty imposed by a judge on a party or attorney for violation of a court rule, for receiving a special waiver of a rule, or as a fine for contempt of court. If a fine, the sanction may be paid to the court or to the opposing party to compensate the other side for inconvenience or added legal work due to the rule violation.
2. v. To impose a fine or penalty as part of a judge's duty to maintain both order and fairness in court (IE. Generally, it is punishment)
Magistrate: 1. n. A Druid assigned to oversee the implementation of a sanction. The sanctioned party must prove to the Magistrate that they have fulfilled the requirements of the Arbitration Board.

Arbitration Rules:



Arbitration Between/Among Clans (Clan-Clan)
Fee: None
Arbitrators: 5, including at least one of Greatdruid or Hierophant level

Notification and Requirements: Each party will note the board on Personal with written arguments. The parties must agree that the decision of the board is binding, and cannot be appealed, except to an Immortal.

Arbitration Method: The decision will be based upon the written arguments, the published petitions of the two involved clans, and the general rules of Aardwolf. (See Help Rules, and clan web pages)

Decision and Sanctions: The decision must be by super-majority (4 of 5), and the any sanctions will then be decided by a simple-majority (3 of 5) of the board. Sanctions will typically be monetary, but other more imaginative sanctions are greatly encouraged. The decision will be written and posted to All on the Clan board, and all affected clan leaders will be notified by Tell. Decisions may also be posted on the Druid web page, at the Druids' discretion in consultation with the affected clans' leadership.

Fines must be paid immediately upon notification of the decision. Any unpaid balance will accrue an interest of 10% per month. A clan that has an unpaid balance that is older than 14 days cannot initiate arbitration with another clan until the debt is payed off.

If a non-monetary sanction is applied, one Druid of any level is assigned Magistrate to oversee the sanction (such as clan quests). The sanctioned clan will notify this Magistrate when the sanction is completed, and that Magistrate will notify the clan leaders of all affected clans, and the Arbitration Board, on Personal. The Magistrate may require proof of completion. If the sanctioned clan disagrees with a decision of the Magistrate, they can appeal to the full Arbitration Board, with a simple majority required to approve the appeal.

Arbitration Between/Among Individuals (Ind-Ind)

Fee: level * 100 (with exceptions decided by Hierphants)
Arbitrators: 3, including at least one of Head Druid or higher


Notification and Requirements: Arbitration between individuals can begin under two circumstances:

1. Both parties agree to Arbitration. The arbitration is binding.
2. An Immortal orders Arbitration. The arbitration is binding, and is not voluntary.

Arbitration Method: Each party will note Druid on Personal with written arguments. If the arbitration is ordered by an Immortal, and any of the parties does not note Druid on Personal, the decision will be rendered using all available facts.

Other parties may note Druid on Personal if they were direct witnesses to any events being discussed during the arbitration.

Decision and Sanctions: The decision must be unanimous, but sanctions only need a majority (2 of 3).

If no decision can be made by the three members, a five-member board is convened, and cannot include the previous three members. This board will follow the rules of a clan-clan arbitration board.

Sanctions will often be monetary, but may also include equipment exchanges, cleansing quests, and other meaningful actions, including public apologies.

If a non-monetary sanction is applied, one Druid of any level is assigned Magistrate to oversee the sanction (such as clan quests). The sanctioned individual will notify this Magistrate when the sanction is completed, and that Magistrate will notify all affected parties, and the Arbitration Board, on Personal. The Magistrate may require proof of completion. If the sanctioned clan disagrees with a decision of the Magistrate, they can appeal to the full Arbitration Board, with a simple majority required to approve the appeal.

If a party refuses to accept the decision of the Arbitration Board, that party can appeal only to an Immortal. If the party further refuses to abide by the decision of the Arbitration Board, the Druid Clan will seek direct intervention by the Immortals, and will request a sanction. This request will be made in a note to IMM on personal from one member of the Arbitration Board, or by a Druid Leader.

Miscellaneo us Mediation:

The Great Circle of Druids and its members may, at their discretion, act as Intermediaries between/among citizens of Midgaard and its surrounding regions for issues that do not require the mediation process.
